PRIVACY POLICY

This Privacy Policy explains what information OddsUp LLC ("OddsUp," "we," "us") collects when you use the OddsUp website and application at oddsupapp.com (the "Service"), how we use it, who we share it with, and what choices you have. It forms part of our Terms & Conditions.

1. INFORMATION YOU GIVE US

• Account information: the email address and password you use to create an account. Passwords are handled by our authentication provider and are stored only in hashed form. We never see your plaintext password.
• Payment information: when you subscribe, our payment processor collects your card details, billing address, and name directly. Those details go to the processor, not to us. We receive only a customer reference, the last four digits of the card, the card brand, and the status of each payment. We never see or store your full card number.
• Support correspondence: anything you send to support@oddsupapp.com, including the contents of your message.

2. INFORMATION WE COLLECT AUTOMATICALLY

• Activity in the Service: the selections you generate, the legs included, the model figures shown at the time, and the outcome once the event settles. We use this to measure and improve model accuracy and to display your history back to you.
• Technical and log data: IP address, browser type and version, device type, operating system, referring page, pages viewed, and timestamps. This is standard server and application log data.
• Local storage identifier: we store a randomly generated client identifier in your browser's local storage so the Service can recognise your session and retain your preferences between visits. It is not tied to your identity unless you are signed in.

3. CONTENT YOU SUBMIT TO US

You may choose to send us screenshots of betting slips, results, photographs, comments or testimonials — by email, by message or tag on our social media accounts, or through any feature that invites you to share. We call these Submissions. Sending one is entirely voluntary and nothing in the Service requires it.

A Submission may contain personal information about you — commonly your name, your social media handle, your stake sizes, your sportsbook account number or balance, and the outcome of your bets. A screenshot in particular can reveal far more than you intend.

• Redact before you send. Remove or obscure your account number, your balance, your legal name, and anything else you would not want published. We may redact material ourselves, but we are not obliged to and you should not rely on us to do it.
• Attribution. We may publish a Submission with your first name, your handle, or anonymously. Tell us in writing which you prefer and we will follow it for anything published after that request.
• Other people. Do not send us content containing another person's personal information without their permission, and never content identifying anyone under 21.
• Withdrawal. Email support@oddsupapp.com to ask us to stop using a Submission. We will stop using it in new material within a reasonable period. Material already published, printed, or shared onward by others may remain, and content on third-party platforms cannot always be recalled.
• Retention. We keep Submissions for as long as we use them promotionally and for a reasonable period afterwards for records. Where a Submission has been published, we may retain a copy of what was published and when.

We do not sell Submissions, and we do not pass them to third parties for their own advertising.

4. WHAT WE DO NOT COLLECT

We do not collect Social Security numbers, government identification numbers, precise geolocation, biometric data, or health information. We do not knowingly collect information from anyone under 21.

5. HOW WE USE INFORMATION

• To create and maintain your account and authenticate you;
• To deliver the Service, including generating simulations and displaying your history;
• To process subscription payments, renewals, and refunds;
• To send transactional messages — receipts, renewal notices, password resets, service announcements;
• To measure and improve model accuracy and product performance;
• To detect, investigate, and prevent fraud, abuse, credential sharing, and automated scraping;
• To publish Submissions you send us, as described in section 3;
• To comply with legal obligations and enforce our Terms.

We do not sell your personal information, and we do not share it with third parties for their own advertising purposes.

6. MARKETING EMAIL

If you opt in, we may send occasional product news. Every marketing message includes an unsubscribe link, and unsubscribing takes effect promptly. Transactional messages about your account and billing are not marketing and cannot be opted out of while your subscription is active.

7. WHO WE SHARE INFORMATION WITH

We share information only with service providers who need it to operate the Service, and only for that purpose:

• Google (Firebase and Google Cloud): authentication, database, and hosting for the application.
• Stripe: payment processing, subscription billing, and fraud screening. Stripe acts as an independent controller of the payment data it collects and applies its own privacy policy.
• Netlify: hosting, content delivery, and server-side traffic analytics for the website.
• Google Workspace: business email and productivity.

We may also disclose information where required by law, subpoena, or court order; to protect our rights, safety, or property; or in connection with a merger, acquisition, or sale of assets, in which case we will notify you before your information becomes subject to a different privacy policy.

Referral links to sportsbooks may carry an identifier that tells the operator the visit came from OddsUp, so that referral can be attributed to us. This does not transmit your identity, your email address, or your account information.

8. COOKIES AND LOCAL STORAGE

We use browser local storage for session and preference data as described above.

Site traffic is measured using Netlify Analytics, which works from server request logs rather than from a script running in your browser. It sets no cookies, stores nothing on your device, and does not track you across other websites. It processes your IP address to count unique visits, and reports only aggregated figures to us — page views, referring sites, popular pages, and error pages. We cannot identify an individual visitor from it.

We do not use third-party advertising cookies or cross-site tracking. If we add any further analytics tool, this policy will be updated to name it and describe what it collects before it is enabled.

9. DATA RETENTION

• Account information is retained while your account is active and for 12 months after closure, so the account can be restored if you return.
• Billing records are retained for 7 years, as required for tax and accounting purposes.
• Activity and model-outcome data may be retained indefinitely in aggregated or de-identified form, which cannot be linked back to you.
• Server logs are retained for 90 days.

10. SECURITY

We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold, consistent with the New York SHIELD Act. These include encryption in transit, authenticated access controls on stored data, hashed password storage, and restricted internal access.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and any required regulator in accordance with applicable law.

11. YOUR CHOICES AND RIGHTS

Regardless of where you live, you may:

• Access the personal information we hold about you;
• Correct information that is inaccurate;
• Delete your account and the personal information associated with it, subject to records we must keep by law;
• Export your account and activity data in a portable format;
• Withdraw marketing consent at any time.

To exercise any of these, email support@oddsupapp.com. We will respond within 45 days. We will not deny service, charge a different price, or provide a lesser experience because you exercised a privacy right.

California residents: the California Consumer Privacy Act gives you rights to know, delete, correct, and opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined, so there is nothing to opt out of, but the other rights apply and are exercised through the same email address above.

12. AGE RESTRICTION

The Service is restricted to people aged 21 and over. We do not knowingly collect personal information from anyone under 21, and we do not knowingly collect information from children under 13 as defined by the Children's Online Privacy Protection Act. If we learn that we have collected information from someone under 21, we will close the account and delete the information. If you believe a minor has provided us information, contact support@oddsupapp.com.

13. THIRD-PARTY SITES

The Service links to third-party sportsbook operators and other external sites. We do not control those sites and are not responsible for their content or privacy practices. Read their policies before providing information to them.

14. WHERE YOUR INFORMATION IS HELD

The Service is operated from the United States and information is stored on servers located in the United States. If you access the Service from outside the United States, you consent to your information being transferred to and processed in the United States, where privacy laws may differ from those of your country.

15. CHANGES TO THIS POLICY

We may update this Policy. Material changes will be notified by email to the address on your account, or by prominent notice on the Service, at least 14 days before taking effect. The "Last updated" date above always reflects the current version.
